Is David going to jail?
We all know Jenelle Evans likes bad boys. While David is nowhere near as bad as her former boyfriends, he’s not completely innocent.
In March of last year, David happened to see his son out at the supermarket and went to give him a hug. Sounds harmless, right? Well, not when that hug violated a protective order.
David was found guilty and was sentenced to 60 days in jail. After appealing the decision and getting his court date pushed back, David finally went back to court on Monday, March 20th.
Making Assumptions
While no official reports have been released regarding David’s recent court appearance, fans are beginning to make assumptions based on his and Jenelle’s behavior on social media.
One Teen Mom viewer believes that David did not win the appeal because Jenelle would be “bragging about it all over Twitter.” Some believe that David lost his case and has some time to surrender.
Other fans believe that David did not show up for his court date.
Digging for Details
Viewers of the show are speculating that David did not show up to court, but possibly sent his lawyer. Or possibly, Jenelle had an upcoming Kesha concert to attend and needed the date to be rescheduled.
While we wait to hear the official reports, fans are doing some serious digging. One fan noted that David cut his fingers and got a note from a doctor to reschedule.
Fan Theories
People are speculating and creating theories based on Jenelle’s past behavior. One fan mentions, "She ALWAYS tweets about court cases when they go in her favor. He could have to go to jail still but doesn't have to report just yet.”
Others noticed that Jenelle and David seem perfectly happy on their Snapchats, so things must not be that bad.
Original Sentence
The sentence was given in September 2016, while Jenelle was pregnant with their child, Ensley. Many fans worried that David would be behind bars when Jenelle went into labor. Fortunately, this was not the case as David appealed the decision and given a new court date.
Jenelle took to Twitter to dish out some of the court details.
Jenelle's Details
"The no contact order expires Oct. 22nd then he will be filing for visitation for his son that his ex is refusing to let David see. The judge found him guilty saying ‘an unwanted hug is a form of child abuse,’ same judge that granted the no contact order and that wrote up his custody papers when he had no way to even fight against his ex, the judge even knew this. she hates David. Wouldn’t even listen to a word Dustin had to say while he was speaking and she rolled her eyes at Dustin. How respectful," Jenelle said.
David's Arrest
David was arrested on March 28th. According to the report, here is what led to his arrest:
Defendant was in the same location as his child Kaden who was out with his grandmother and aunt when defendant approached same and hugged Kaden. [David] was told not to by [name redacted] and grabbed the child again which frightened same.
Dispute Turns Violent
So why was there a protective order to begin with?
Radar reports that David and his ex-girlfriend were involved in a dispute that turned violent. In April 2014, David allegedly choked his then girlfriend while she was pregnant. According to court papers, he threatened her too.
“The Defendant did assault [name redacted], a female person, by grabbing the victim around the throat and saying to the victim, ‘I will kill you b****,’” court documents read.
